1. Service provider identification

In compliance with article 10 of Spanish Act 34/2002 of 11 July on Information Society Services and Electronic Commerce (LSSICE), the provider's details are:

2. Purpose

These Terms govern the use of the prisma service (the "Service"), a platform for SEO and GEO (generative engine optimisation) visibility analysis across search engines and generative AI models, accessible at seogeo.quantumnovaagency.com.

By registering and using the Service you expressly accept these Terms, the Privacy Policy and the Cookie Policy. If you do not agree, do not use the Service.

3. User account and access

3.1 Registration

To use the Service you must create an account with at least a name, email and password. You warrant that the information you provide is accurate, complete and current, and you agree to keep it so.

3.2 Minimum age

You must be an adult (18+) or have the express consent of your legal guardian.

3.3 Credentials

You are responsible for keeping your password confidential and for any activity under your account. Notify info@quantumnovaagency.com immediately of any unauthorised use.

3.4 Suspension

We may suspend or cancel accounts, with or without prior notice, where we reasonably believe these Terms, applicable law or the Service's security have been breached.

4. Acceptable use

You agree to use the Service lawfully. In particular, the following is prohibited:

Analysing domains, profiles or digital assets you do not own or have not been authorised to analyse, other than competitive analysis of publicly available information.
Reselling, redistributing, licensing or transferring to third parties the reports, scores or data obtained, beyond the use permitted by your plan (e.g. an agency plan does allow sharing reports with your own clients).
Attempting to circumvent quotas, suspensions, payment mechanisms, security or authorisation checks.
Reverse engineering, decompiling or otherwise trying to obtain the Service's source code.
Introducing viruses, malicious code or attacks against the integrity, availability or confidentiality of the Service.
Using the Service for unlawful, fraudulent, defamatory or rights-infringing purposes.
Automating the Service via bots or scrapers beyond the limits of your plan.

5. Plans, payments and cancellation

5.1 Plans

Plans, usage limits (daily quotas for analyses, geo, content and serpApi) and prices are published at /pricing and may change. The price applicable to you is the one in force at the time of purchase or renewal.

5.2 Payment processor

Payments are processed by Stripe, Inc. (with EU representation). prisma does not store full card data; only the opaque customer identifier and the subscription status.

5.3 Billing and renewal

Subscription plans renew automatically for periods equal to the initial one unless cancelled at least 24 hours before the end of the current period. Invoices are issued electronically.

5.4 Right of withdrawal

Under article 103(m) of the Spanish Consumers Act, by accepting these Terms and starting immediate execution of the digital Service, you expressly waive the 14-day right of withdrawal for the period actually delivered. Nevertheless, we evaluate refund requests case by case during the first 14 days where no material quota has been consumed.

5.5 Cancellation

You can cancel at any time from /billing or through the Stripe Customer Portal. Cancellation takes effect at the end of the period already paid.

5.6 Non-payment

If payment fails, the Service may be suspended after 7 calendar days and permanently closed after 30 days. We may claim the amount owed under applicable law.

6. Intellectual and industrial property

All rights in the Service — software, design, interface, code, logos and the "prisma" trademark — belong to QuantumNova Agency or its licensors. These Terms do not transfer any such rights.

Reports and data generated from your own content belong to you. You grant us a limited, non-exclusive, revocable licence to process them for the sole purpose of providing the Service.

7. Data protection

Personal data processing is governed by our Privacy Policy, which forms part of these Terms.

8. Third-party APIs and services

We rely on third-party APIs (Anthropic, OpenAI, Google, Perplexity, xAI, DeepSeek, Mistral, SerpAPI, Stripe, etc.). Their availability, accuracy and continuity are outside our control and may vary. We are not liable for failures, changes or withdrawal of such external services.

9. Availability and maintenance

The Service is provided "as is" and "as available". We may carry out scheduled maintenance that causes temporary interruptions, communicating them where reasonable. We do not guarantee uninterrupted or error-free availability.

10. Limitation of liability

To the maximum extent permitted by law:

We are not liable for indirect damages, lost profits, loss of opportunity, reputational harm or business decisions made on the basis of Service data.
Our total aggregate liability is capped at the amount paid by the user in the 12 months preceding the event giving rise to liability.
Nothing limits liability for intent, gross negligence or damage to life or health.

11. Changes to the Terms

We may modify these Terms by publishing the updated version at this URL. Material changes will be notified by email at least 15 days in advance. Continued use after the effective date implies acceptance.

12. Governing law and jurisdiction

These Terms are governed by Spanish law. Any dispute will be submitted to the Courts of the consumer's domicile when the consumer is the claimant; otherwise, to the Courts of the owner's registered seat.

EU consumers may use the European online dispute resolution platform at ec.europa.eu/consumers/odr.
